Terms of Service

Please read these Terms of Service carefully before using Serve MCP. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Serve MCP(“Company,” “we,” “us,” or “our”) governing your access to and use of the Serve MCP platform, including any associated software, APIs, websites, and services (collectively, the “Service”).
By creating an account, accessing the Service, or clicking “I agree,” you represent that (a) you are at least 18 years of age; (b) you have the legal authority to enter into these Terms; and (c) you agree to be bound by these Terms and our Privacy Policy.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Service Description
Serve MCP provides a hosted Model Context Protocol (MCP) server platform that allows users to connect third-party tools (such as Shopify, GitHub, and PostgreSQL databases) to MCP-compatible AI clients (such as Claude, Cursor, and ChatGPT). The Service enables AI assistants to access user-authorized data through read-only tool calls.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable advance notice where possible. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time.
3. User Accounts
You must create an account to use the Service. You agree to provide accurate, complete, and current information during registration and to keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials, including your password and MCP bearer tokens. You agree to notify us immediately at legal@servemcp.com if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account, whether or not you authorized it. We are not liable for any loss resulting from unauthorized use of your account.
Each account is for use by a single organization or individual. You may not share accounts across organizations without our prior written consent.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right
- Access, scrape, or store data you are not authorized to access
- Attempt to circumvent rate limits, authentication, or security controls
- Reverse engineer, decompile, or disassemble any part of the Service
- Introduce malware, viruses, or malicious code into the Service
- Use the Service to provide services to third parties without our consent
- Impersonate any person or entity, or misrepresent your affiliation
- Interfere with or disrupt the integrity or performance of the Service
- Build a competing product or service using our API or underlying technology
We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy at our sole discretion.
5. Payment Terms
Certain features of the Service are available only through paid subscription plans. By subscribing to a paid plan, you authorize us to charge the applicable fees to your designated payment method on a recurring basis.
All fees are in US Dollars and are non-refundable except as explicitly stated in our Refund Policy. Subscription fees are billed in advance on a monthly basis.
If your payment fails, we may suspend your access to paid features until payment is resolved. Accounts with outstanding balances for more than 14 days may be subject to downgrade or termination.
We reserve the right to change our pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
6. Intellectual Property
The Service, including its software, design, trademarks, and all related intellectual property, is owned byServe MCP and its licensors. These Terms do not grant you any rights to use our trademarks, logos, or other branding without our prior written consent.
You retain all rights to data you submit to or access through the Service (“Your Data”). By using the Service, you grant us a limited, non-exclusive license to process Your Data solely as necessary to provide the Service.
Any feedback, suggestions, or ideas you provide to us about the Service are provided voluntarily, and we may use them without any obligation to you.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
8. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVE MCP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
9. Termination
You may terminate your account at any time by canceling your subscription and deleting your account from the dashboard settings.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, non-payment, or inactivity.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — will survive.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Notwithstanding this, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
